MULTI-LINK Communications Products (MLCP) WARRANTY & RETURN POLICY:
MULTI-LINK warrants that all equipment sold will be free of defects in workmanship and material for the lifetime of said equipment, provided that buyer properly uses and maintains equipment. This Lifetime warranty does not apply to any equipment that becomes defective due to abuse, misuse, neglect, improper handling, improper use or installation, lack of proper maintenance, improper configuration or modifications, improper testing, or accident. The warranty does not apply if equipment becomes faulty due to environmental factors, including but not limited to, customs x-ray, natural disasters, fire, flood, earthquake, power surges or incorrect electrical voltages, extreme temperatures, or lightning.
Any attempt to repair equipment without expressed, written authorization by MULTI-LINK will automatically void warranty.
This warranty is only valid for the original purchaser of the equipment (“buyer”) and is not transferable. Upon sale or transfer of equipment by buyer to any other party, this warranty, and all other warranties set forth by MULTI-LINK terminate permanently.
MULTI-LINK's Lifetime warranty applies to new, new surplus, used, and refurbished equipment. The warranty covers only defective or non-working items and is for our retail end-user customers only who must also be the original purchaser of the equipment from MULTI-LINK. In some instances, MULTI-LINK's warranty may be limited to the reasonable market lifetime of the product. Products sold that are eligible for a factory warranty may be warranted by their respective manufacturer, and are not covered under MULTI-LINK’s Lifetime Warranty. If products are not eligible for factory warranty, MULTI-LINK will warranty the equipment with our Lifetime warranty unless another warranty was stated at the time of quotation.
MULTI-LINK reserves the right to test and confirm all claims and, upon confirmation, and at its sole discretion, will either issue a credit, refund or replacement, or will repair the defective equipment. In the event MULTI-LINK chooses to replace the faulty equipment, MULTI-LINK may, at its discretion, provide Customer with an upgraded or newer model with comparable functionality should the same model be unavailable. All other requests for return of equipment, for any reason whatsoever, or purchase order cancellation by customer, will be subject to a minimum 20% (of total order) restocking charge or reimbursement for costs incurred to fulfill order, whichever is higher.
If buyer improperly returns equipment claiming that it was defective but MULTI-LINK determines that equipment is not defective, buyer shall be liable for all shipping costs associated with the return. In addition, if MULTI-LINK issued a credit to buyer for improperly returned equipment, MULTI-LINK may cancel the credit. If MULTI-LINK sent replacement parts or equipment for improperly returned equipment, buyer will be deemed liable for the cost of sent replacement equipment as well as shipping costs and MULTI-LINK may invoice buyer accordingly.
Some restrictions to our Lifetime warranty & return policy may apply for special order items. (See "Return Policy" below.)
This warranty does not apply to equipment purchased in wholesale transactions. Additionally, this warranty does not apply to mainframes, software, batteries, licenses or any equipment provided as part of MULTI-LINK’s maintenance services.
In the event of a warranty claim:
Customer is to notify MULTI-LINK in writing with a description of the failure(s) or material defect(s), the serial number(s) of the item(s) and either MULTI-LINK invoice number or customer Purchase Order number.
MULTI-LINK will issue a Return Merchandise Authorization (RMA) with return instructions. RMA will remain valid for up to 10 calendar days, at which time returned product must be received by MULTI-LINK or, at a bare minimum, equipment must be in route to MULTI-LINK, verified by a valid airway bill number. MULTI-LINK may pay, via a carrier of its choice, for the return freight expenses on domestic shipments provided defective equipment is shipped from the same locations to which MULTI-LINK initially delivered the equipment, or another location with comparable shipping costs. Any additional shipping cost is the responsibility of the buyer. For international returns, buyer is responsible for return freight (and any applicable customs charges) on international return shipments, and must use one of MULTI-LINK’s approved international carriers. Any product returned to MULTI-LINK without prior authorization from MULTI-LINK, or via an unauthorized carrier, will be considered an unauthorized return, and the customer will not receive credit for the product and MULTI-LINK may not ship the product back to customer.
Subject to availability of item(s) in question at the time of the warranty claim, MULTI-LINK will send an advance-exchange replacement(s). In such instances, MULTI-LINK may pay outgoing freight for the replacement(s) on domestic shipments, said freight to be equivalent to freight paid to location of original shipment (buyer may be responsible for all shipping costs on international shipments). In the event that MULTI-LINK sends an advance-exchange replacement, customer will be billed in full for said replacement; however, a credit will be issued – in full – provided that equipment under warranty claim is received within the time period specified by MULTI-LINK at time of replacement shipment.
For items returned under warranty and verified by MULTI-LINK to be defective, and warranty replacements are not available, MULTI-LINK may opt to repair the equipment, replace the equipment with similar or upgraded equipment, issue a credit to the customer account, or issue a refund in same amount. Should MULTI-LINK provide a replacement, refund, or credit, such remedy will be the sole and exclusive remedy and MULTI-LINK shall not be liable, in any event, for any damages in connection with loss of use, loss of data, or loss of revenue. Return of equipment implies buyer understands and agrees that no claims for such losses may be made against MULTI-LINK.
For items returned under warranty and determined by MULTI-LINK to be in working order and free of material defect, MULTI-LINK will bill customer for, a) any incurred incoming and outgoing freight expenses for the return and replacement of said equipment; and b) a technician charge at MULTI-LINK's then-prevailing rate.
This warranty replaces all other warranties, expressed or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. MULTI-LINK makes no expressed warranties beyond those stated here. MULTI-LINK disclaims all other warranties, expressed or implied including, without limitation, implied warranties of merchantability and fitness for a particular purpose.
In no event shall MULTI-LINK be liable for special, collateral, incidental, or consequential damages in connection with or arising out of purchase or use of these materials. The sole and exclusive liability of MULTI-LINK, regardless of the form or action, shall not exceed the purchase price of the materials in question.
Return Policy for Non-Defective Equipment:
In the event a customer wishes to request the return of a non-defective product, customer must request return within 10 calendar days of receipt of said product. No returns will be accepted without a Return Merchandise Authorization (RMA) number, which RMA is granted at the sole discretion of MULTI-LINK. The purchaser is responsible for freight charges on the return and original shipments. Returned equipment must come in original packaging and include all originally-provided accessories. Returns may not be allowed for special order items. Any product returned to MULTI-LINK without prior authorization from MULTI-LINK will be considered an unauthorized return, and the customer will not receive credit for the product and MULTI-LINK may not ship the product back to customer.
RMA will remain valid for up to 10 calendar days, at which time returned product must be received by MULTI-LINK or, at a bare minimum, equipment must be in route to MULTI-LINK, verified by a valid airway bill number.
Damaged, Missing or Incorrect Equipment Notification Policy:
Customer must check the contents of an equipment shipment upon receipt. If customer finds an incorrectly shipped, missing or damaged item, and that item is not otherwise back-ordered or sent in a separate shipment, customer must report the instance to their Sales Representative, in writing, within 10 calendar days, advising as to customer PO#, MULTI-LINK invoice number and airway bill #. Notifications received after 10 calendar days may not be honored.
General Price Quotation Terms & Conditions:
All pricing is in US$ and is for used/refurbished equipment unless indicated otherwise. All payments are to be made in US currency. The price included herein reflects a 3% discount for payment by cash, check or wire transfer. This discount may not apply if customer pays using a credit, PayPal or similar. All payment terms listed on quote are subject to credit approval. Software licenses are not included unless specifically stated otherwise. It is the customer’s responsibility to ensure that it is ordering the correct equipment. Any specific manufacturing date, release or revision level requirements (i.e. “releases”) for equipment must be identified by customer at time of initial request, as Multi-Link (MLCP) will not be held liable or obligated to provide such “releases” unless otherwise agreed. Leadtimes listed on the attached are typically estimates and not a guarantee of an actual ship date. MLCP will not be held liable for any delays unless otherwise agreed. Pricing is based on conditions existing at time of quotation and is subject to change by the seller; all pricing is subject to prior sale and should be confirmed prior to placing purchase order. MLCP makes no guarantees on product eligibility for factory maintenance programs and will not be held liable in the event that goods are ineligible for such maintenance nor will MLCP be held liable if the manufacturer cancels any such maintenance contract for equipment sold by MLCP. Shipping charges, including, but not limited to, freight, insurance & applicable duties, tariffs & taxes are extra, and are not included in quotation, unless specially stated otherwise. This quotation is not subject to verbal changes; only written changes that are approved in writing by the seller shall be binding. Stenographic & typographical errors are subject to correction.
For items under MULTI-LINK 3rd Party Support:
Multi-Link (MLCP) support customers: if HDD or tape drives are not listed in customer RFQ and/or not listed in our quotation, they are excluded under any new support contract and may be supported under T&M only. MLCP reserves the right to confirm all equipment placed under support is fully-functional. Support may be declined on equipment found to have pre-existing conditions or equipment that was exhibiting failures prior to the start of coverage. Relocation & Upgrades: Multi-Link (MLCP) must receive advance written notice and approve of any plan by Customer to either relocate or upgrade any item of equipment covered under contract. For relocations, if there is more than one install facility listed on a contract (i.e. on a PO), Customer may relocate items of Covered Equipment from their original location to any other facility listed within contract/PO, at no additional cost, by providing advance notice to, and approval from, MLCP. Similarly, as IOS (software/firmware) upgrades are not included in 3rd Party support, MLCP must receive advance written notice and approve of any plan by Customer to upgrade any item of equipment covered under contract. In lieu of such advance notice & approval of an equipment move or upgrade, additional charges may apply before equipment will be covered/re-covered, and MLCP shall have no obligation to provide services for any such equipment until MLCP confirms equipment is back to fully operational. In the event that a break-fix incident requires firmware support services, MLCP will provide reactive firmware support to bring an asset back to its pre-failure state. MLCP will replace physical components and assets with hardware that contains matching- or latest-compatible firmware revisions to ensure full operability within the customer’s environment. If an OEM firmware purchase, deployment, or installation is not part of a reactive break-fix event, it is not included under the scope of services, and any support will be on T&M basis. Notices required must be provided in writing (fax, USPS mail or by email).
Purchase order placement by buyer confirms acceptance of these conditions & terms. Those conditions not specifically stated herein shall be governed by applicable trade laws. Terms and/or equipment types/quantities inconsistent with those herein stated, which may appear on Purchaser's order form, will not be binding on the seller.
